1. Overview

AdaptiveShop is committed to maintaining a safe, legal, and respectful platform for all users. This AUP outlines prohibited activities and content. You agree to use the Platform only for lawful purposes and in compliance with all applicable laws and regulations.

We reserve the right to investigate violations, suspend or terminate accounts, remove content, and cooperate with law enforcement authorities as appropriate.

Right to Refuse Service: AdaptiveShop reserves the right to refuse service to anyone for any reason at any time, at our sole discretion.

2. Prohibited Activities

You may NOT use the Platform to:

2.1 Illegal Activities

• Engage in or facilitate any illegal activity
• Violate any local, state, federal, or international laws
• Sell illegal products or services
• Engage in money laundering or sanctions evasion
• Facilitate fraud, theft, or identity theft

2.2 Fraudulent or Deceptive Practices

• Make false, misleading, or deceptive claims
• Engage in bait-and-switch tactics
• Misrepresent products, prices, or business identity
• Create fake reviews or testimonials
• Impersonate another person or entity
• Use the Platform to run scams, pyramid schemes, or multi-level marketing

2.3 Intellectual Property Violations

• Infringe copyrights, trademarks, patents, or other intellectual property rights
• Sell counterfeit or replica goods
• Use unauthorized brand names, logos, or designs
• Upload content you do not own or have rights to use

2.4 Harmful or Abusive Conduct

• Harass, threaten, stalk, or abuse others
• Post hate speech or discriminatory content
• Promote violence or harm to individuals or groups
• Share sexually explicit or pornographic material
• Exploit or harm minors
• Engage in doxxing or invasion of privacy

2.5 Platform Abuse

• Attempt to gain unauthorized access to accounts, systems, or networks
• Interfere with or disrupt the Platform's operation
• Use automated tools (bots, scrapers, crawlers) without authorization
• Overload or stress-test systems (denial-of-service attacks)
• Reverse engineer, decompile, or attempt to extract source code
• Circumvent security measures or access controls
• Create multiple accounts to evade bans or restrictions

2.6 Spam and Unsolicited Communications

• Send spam, junk mail, or unsolicited marketing
• Use customer data for unauthorized marketing
• Harvest or collect user information without consent
• Engage in phishing or social engineering

3. Prohibited Products and Content

You may NOT sell, list, or promote:

3.1 Illegal or Restricted Goods

• Illegal drugs, controlled substances, or drug paraphernalia
• Weapons, firearms, explosives, or ammunition
• Stolen property or goods obtained through illegal means
• Prescription medications or medical devices without proper licensing
• Tobacco or vape products (unless licensed and compliant)
• Alcohol (unless licensed and age-verified)

3.2 Dangerous or Harmful Products

• Hazardous materials or chemicals
• Recalled or unsafe products
• Products that pose health or safety risks
• Items without required safety warnings or certifications

3.3 Prohibited Content

• Adult or sexually explicit content
• Hate speech, discriminatory, or offensive material
• Violent or graphic content
• Content promoting illegal activities
• Misleading health, medical, or safety claims

3.4 Other Prohibited Items

• Live animals
• Human remains or body parts
• Items that violate export or import restrictions
• Services that violate applicable laws

4. Account Security Requirements

You are responsible for maintaining the security of your account. You agree to:

• Keep your login credentials confidential and secure
• Not share your account with others
• Immediately notify us of any unauthorized access or security breach
• Use strong, unique passwords
• Be responsible for all activities conducted under your account

AdaptiveShop is not liable for losses resulting from unauthorized account access due to your failure to maintain account security.

5. Compliance with Laws

You agree to comply with all applicable laws, including but not limited to:

• Consumer protection laws
• Privacy and data protection laws (GDPR, CCPA, etc.)
• Advertising and marketing regulations
• Export and import laws
• Tax laws and reporting obligations
• Industry-specific regulations applicable to your products or services

You are solely responsible for ensuring compliance. AdaptiveShop does not guarantee that your use of the Platform complies with applicable laws in your jurisdiction.

No Legal Advice: AdaptiveShop does not provide legal advice and does not determine whether your products, content, or activities comply with applicable laws. You are responsible for understanding and complying with all laws that apply to your business and jurisdiction.

6. Enforcement and Consequences

Violations of this AUP may result in one or more of the following actions, at AdaptiveShop's sole discretion:

• Warning or Notice: We may contact you to address the violation
• Content Removal: Immediate removal of violating content
• Account Suspension: Temporary suspension of your account
• Account Termination: Permanent closure of your account
• Payout Holds: Freezing of funds pending investigation
• Legal Action: Pursuit of civil or criminal remedies
• Reporting to Authorities: Cooperation with law enforcement

We do not guarantee that we will take action on every violation. Failure to enforce this AUP in one instance does not waive our right to enforce it in other instances.

No Refunds: Account termination due to AUP violations does not entitle you to refunds of subscription fees or other payments.

7. Reporting Violations

If you become aware of conduct or content that violates this AUP, please report it to us:

We will review all reports and take appropriate action as we deem necessary. We are not obligated to investigate every report or provide updates on enforcement actions.

8. No Guarantee of Enforcement

AdaptiveShop does not:

• Pre-screen or review all merchant content before publication
• Guarantee detection or removal of all violating content
• Act as an arbiter or judge in disputes between users
• Guarantee the accuracy, safety, or legality of any merchant content

We rely on user reports and automated systems to identify violations. Monitoring is voluntary and does not create an ongoing obligation.

9. Limitation of Liability

To the maximum extent permitted by law:

• AdaptiveShop is not liable for damages arising from user violations of this AUP
• AdaptiveShop is not liable for losses resulting from enforcement actions (content removal, account suspension, etc.)
• AdaptiveShop is not liable for harm caused by other users' violations
• You agree to indemnify AdaptiveShop for any claims arising from your violations

10. Changes to This Policy

We may update this AUP at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of the Platform after changes constitutes acceptance of the revised AUP.

11. Governing Law

This AUP is governed by the laws of the State of California, without regard to conflicts of law principles. Any disputes shall be resolved through binding arbitration in Los Angeles County, California.
